What Are South Dakota’s Delta 8 Laws? Is Delta 8 Legal?
Delta 8 THC is legal in South Dakota, and, in alignment with the federal rulings, South Dakota has specifically legalized all derivatives, cannabinoids, and isomers of hemp, and this includes tetrahydrocannabinols aside from delta 9 THC.
Under 2019 House Bill 1191 Section 1, marijuana is officially defined as “all parts of any plant of the genus cannabis, whether growing or not, in its natural and unaltered state, except for drying or curing and crushing or crumbling. The term includes an altered state of marijuana absorbed into the human body.”
However, the term does not include industrial hemp, which is defined in Section 3 as “the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis.”
