What Are Michigan’s Delta 8 Laws? Is Delta 8 Legal?
When it comes to delta 8, the state laws in Michigan are still being debated.
This is mainly because of a stark conflict in the laws regarding industrial hemp, its derivatives, and controlled substances within the state.
In House Bill 6330 Act No. 641, industrial hemp is defined as “the plant Cannabis sativa L. and any part of that plant, including the viable seeds of that plant and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9-tetrahydrocannabinol concentration of not more than 0.3% on a dry weight basis. Industrial hemp includes industrial hemp commodities and products and topical or ingestible animal and consumer products derived from the plant Cannabis sativa L. with a delta-9-tetrahydrocannabinol concentration of not more than 0.3% on a dry weight basis.”

And in Public Health Code Act 368, industrial hemp includes “any part of that plant, including the viable seeds of that plant and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9-tetrahydrocannabinol concentration of not more than 0.3% on a dry weight basis.”

However, delta 8 is also, as per 333.7212 Schedule 1, considered a controlled substance:
(d) Synthetic equivalents of the substances contained in the plant, or in the resinous extractives of cannabis and synthetic substances, derivatives, and their isomers with similar chemical structure or pharmacological activity, or both, such as the following, are included in schedule 1:
(i) /\1 cis or trans tetrahydrocannabinol, and their optical isomers.
(ii) /\6 cis or trans tetrahydrocannabinol, and their optical isomers.
(iii) /\3,4, cis or trans tetrahydrocannabinol, and their optical isomers.

So in some documents, delta 8 can be interpreted as a legal commodity, since it’s a tetrahydrocannabinol derived from hemp. However, tetrahydrocannabinols are listed as Schedule I Controlled Substances, so until the status of delta 8 is specified, it’s unclear whether it’s legal or illegal in the state of Michigan.
