What Are Florida’s Delta 8 Laws? Is Delta 8 Legal?
Delta 8 THC is legal in the state of Florida.
Since the introduction of the 2018 Farm Bill, Florida lawmakers have been working to form cohesive laws around hemp, and de facto, delta 8 THC.
Arguably the most important piece of Florida legislation for delta 8 is Senate Bill 1020, which was passed in 2019 to explicitly legalize hemp, recognizing it as a legal commodity.
In this Bill, industrial hemp is officially defined:
(d) “Hemp” means the plant Cannabis sativa L. and any part of that plant, including the seeds thereof, and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers thereof, whether growing or not, that has a total delta 9 tetrahydrocannabinol concentration that does not exceed 0.3 percent on a dry-weight basis.

As it’s clearly stated that any derivatives of industrial hemp are excluded from controlled substances, delta 8 is thereby legal in the state of Florida for the purpose of selling and purchasing, whether it’s on a wholesale business or otherwise.
