What Are California’s Delta 8 Laws? Is Delta 8 Legal?
Under California state law, delta 8 THC is legal, but only if naturally derived. Under the DEA’s Interim Final Rule, delta 8 converted from CBD is now illegal.
Under Chapter I of the General Provisions and Definitions of the Uniform Controlled Substances Act, the distinction is made between cannabis and industrial hemp. While cannabis is defined as “all parts of the plant Cannabis sativa L., whether growing or not; the seeds thereof; the resin extracted from any part of the plant; and every compound, manufacture, salt, derivative, mixture, or preparation of the plant, its seeds or resin,” industrial hemp is narrowed down to the definition of “a crop that is limited to types of the plant Cannabis sativa L. having no more than three-tenths of 1 percent tetrahydrocannabinol (THC) contained in the dried flowering tops, whether growing or not; the seeds of the plant; the resin extracted from any part of the plant; and every compound, manufacture, salt, derivative, mixture, or preparation of the plant, its seeds or resin produced therefrom.”
In this same section, it’s also stated that industrial hemp in the state of California shall be made subject to the Department of Food and Agriculture for regulatory purposes.
